The filming of a scene portraying a protest against the death penalty at the Texas State Capitol was briefly interrupted when a group of genuine political demonstrators arrived.
To be eligible for capital punishment in Texas, the crime of murder on its own isn't sufficient. There must be an accompanying aggravating offence, and rape is one such offence. David is convicted of rape and murder and therefore becomes eligible for the death penalty. However, he did not rape Constance — their sexual encounter had been entirely consensual — and forensic medicine has, for many years, been able to distinguish between consensual and non‑consensual intercourse. When Constance's body was examined, specialists would have concluded that she had not been raped. Therefore David could not properly have been charged with that offence, and he would not have been eligible for capital punishment.
