Audio/visual unsynchronised

After the accident, Robert comes home and goes to bed. His wife asks where he had been, and he replies "What?" although it is evident that his lips remain motionless.

Character error

The Stern Marling audit report page contains a number of typographical errors. For example, "Local Finances Action Plan" is shown with the acronym "(LBAPs)". The third bullet reads "using an Management Business approach", and the fourth bullet fails to form a coherent sentence.

At the end of the film the camera pans to the Miller family gathered around the table at the party. Brooke's back is visible in the frame, yet her voice is heard introducing her father from the lectern at the very same moment.

Continuity

In the courtroom scene Jimmy deliberately loosens his tie and pulls at his collar in frustration, yet when he is seated on the bench his tie and collar are neatly in place.

While Ellen straightens Robert's tie just before the business dinner, the knot shifts position repeatedly from one shot to the next.

When Robert confronts Chris Vogler, Chris dashes into his office and locks the door. Soon afterwards, when he leaves, he can simply open it because it has somehow unlocked in the meantime.

When Robert nods off while driving the Mercedes, the car's headlamps are unlit when seen from the front, yet its rear lights are clearly visible once the camera cuts to the rear to show the roll-over.

Whilst Robert Miller is talking with Detective Michael Bryer in Miller's office, the position of his tie changes markedly from one shot to the next.

While Julie is talking with Robert in her room, her belt is first fastened from right to left, and then a few seconds afterwards it is fastened from left to right.

When Ellen is exercising at the gym, her sweatshirt is hanging off one shoulder. As she steps away from the equipment to speak, it sits on both shoulders, but when the camera cuts to a different angle it is once again slung off one shoulder.

In a scene where Robert and Jimmy converse in the rear of a limousine on a rainy day, the windows are at times misted over and at others merely clear with raindrops on them.

Coming home from Jimmy's, Robert first phones a servant and then his wife on the bedside telephone. After the initial call, he sits on the bed holding the handset in his right hand, filmed from behind. After the cut, we see him from the front: his arms are oddly folded and the handset rests on the telephone. The pacing, however, implies that no time has passed between the two shots.

Roughly two minutes into the film, Robert Miller is shown travelling as a passenger aboard his private, three‑engined Dassault Falcon. While the aircraft is in flight, conspicuous 12‑inch registration "N-Numbers" appear on the side of the fuselage‑mounted No. 2 engine. After the jet has landed and Miller is filmed disembarking, the large N‑numbers have disappeared and much smaller three‑inch digits can be just made out further back towards the tail.

Crew or equipment visible

As the detectives converse on the bridge at the scene of the crash, shadows cast by the camera crew are visible on their backs.

Factual errors

Miller's accident occurred beyond the boundaries of New York City and outside the NYPD's jurisdiction, so the NYPD would not be the force responsible for investigating the incident.

The film depicts a grand jury being convened in a matter of days. In reality, the selection and assembly of a grand jury can take weeks, if not months.

Plot holes

Why didn’t the police link Miller to the crash by identifying his vehicle? The chassis number (or other distinguishing features) would not have been entirely destroyed by the fire. That evidence would have significantly strengthened the case against him.

Falling asleep at the wheel and causing an accident is not, in itself, a criminal offence. For a manslaughter charge to be brought, there would need to be evidence that he had been negligent and/or that there had been criminal intent. All Miller had to do was admit it was an accident — a mistake — and the charges against him would not have been upheld.
